Agreement to Terms
By accessing mondosports.co, submitting an inquiry, or placing an order, you agree to be bound by these Terms of Service. If you do not agree, please do not use this site.
These Terms apply to all visitors, inquiry submissions, and customers. MONDO Athletic Co. reserves the right to update these Terms at any time. Continued use of the site after updates constitutes acceptance.
Custom Orders and Production
MONDO specializes in custom, made-to-order apparel for Brazilian Jiu-Jitsu academies. Because every product is produced specifically for you, the following terms apply to all custom orders:
- Production begins only after artwork approval. Before any item goes into production, you will receive and must approve a design proof. Your approval — whether written or via email — constitutes authorization to proceed.
- Once production begins, orders cannot be cancelled or modified. We begin manufacturing immediately upon approval. Changes or cancellations requested after production has started cannot be accommodated.
- Custom items are non-refundable. Because products are made specifically to your specifications, we do not accept returns on custom orders except in the case of a manufacturing defect.
- Manufacturing defects will be remedied. If a product arrives with a defect caused by our production process, we will replace the affected items at no charge. Defects must be reported within 14 days of delivery with photographic documentation.
Sizing and Fit
Sizing charts are provided in each school store as a guide. MONDO is not responsible for items ordered in the wrong size when accurate size charts were made available. Customers are responsible for selecting their correct size based on the provided measurements.
For youth products where no physical samples are available, ordering is done by measurements only. This is clearly communicated in the school store. MONDO is not liable for fit issues on youth items when the customer did not follow the measurement-based ordering guidance.
Color accuracy: sublimation printing produces vibrant, accurate results, but colors may vary slightly from how they appear on your screen due to differences in monitor calibration and display settings. This variance does not constitute a defect.
Turnaround Times
Production timelines communicated during the quote process — typically 4 to 8 weeks — are estimates, not guarantees. Factors outside our control, including supplier delays, shipping carrier issues, and customs processing, may affect delivery timing.
MONDO will communicate proactively if there are known delays affecting your order. We are not liable for damages or losses resulting from delivery delays beyond our reasonable control.
Artwork and Intellectual Property
You are responsible for the artwork you submit. By submitting logos, graphics, or other artwork for use in your order, you represent and warrant that you own or have the legal right to use all submitted materials, and that their use does not infringe the intellectual property rights of any third party.
MONDO will not knowingly reproduce copyrighted or trademarked material without authorization. However, we rely on customers to provide compliant artwork. MONDO is not liable for any claims arising from customer-submitted artwork that infringes third-party rights.
Artwork created by MONDO during the design process remains the intellectual property of MONDO until full payment is received, at which point ownership transfers to the customer.
Payment
All payments are processed securely through Shopify. MONDO does not store or handle your payment card information directly. By completing a purchase, you agree to Shopify's terms of service and payment processing policies.
For custom academy orders quoted through our inquiry process, payment terms will be outlined in your quote. Full payment or agreed deposit is required before production begins.
Limitation of Liability
To the fullest extent permitted by law, MONDO Athletic Co. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our site or products, including but not limited to loss of revenue, loss of business, or loss of data.
Our total liability for any claim arising from a product order shall not exceed the amount paid for the specific order giving rise to the claim.
Governing Law
These Terms of Service are governed by the laws of the State of Louisiana, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Louisiana.
